Right of Appeal

Right of Appeal – Challenge Unfair Home Office Decisions

When the Home Office gets it wrong, you have the right to challenge that decision before an independent judge. A Right of Appeal is often the strongest and most effective way to overturn a Home Office decision.

At Lexen Law, we specialise in preparing powerful appeals that present your case with clarity, evidence, and legal precision maximising your chances of success.

What is a Right of Appeal?

A Right of Appeal allows you to challenge certain Home Office decisions at the First-tier Tribunal (Immigration and Asylum Chamber).

This means the Tribunal judge can reconsider everything:

Your circumstances

Your evidence

Your credibility

How the Home Office applied the law

If the refusal was wrong, the Tribunal can overturn the decision fully.

A refusal is not a final answer with the Right of Appeal, your voice can be heard and justice can prevail.

When Do You Have a Right of Appeal?

You may have a Right of Appeal if the Home Office has refused:

Human rights applications (e.g., family life, private life, long residence)

    Asylum and protection claims

    EU Settlement Scheme (EUSS) applications

    Certain revocation decisions

You will usually have 14 days to appeal from the date the decision was sent from within the UK, and 28 days to appeal from the date the decision was received from outside of the UK.

If you are unsure whether your decision is appealable, we can check this for you immediately.

    Why Appeals Matter

    A Right of Appeal:

Allows a full reconsideration of the decision based on facts, evidence, and law

Provides an independent hearing where a judge not the Home Office decides your case

Lets you submit new evidence, witness statements, medical reports, expert evidence and more

Protects you from removal, as most appeals allow you to stay in the UK while the case is heard

Can overturn wrongful refusals, restoring your rights and immigration status

A strong appeal can make the difference between refusal and securing your future in the UK.

How We Build a Winning Appeal

We take a detailed, evidence-driven approach. Your appeal will include:

    1. Expert Legal Analysis

We scrutinise the refusal and identify every legal error and evidential gap.

    2. Strong Evidence Preparation

    This includes:

Witness statements from you and supporting individuals

    Medical or psychological reports

    Expert country evidence

    Financial, relationship, or accommodation evidence

    Character references

Anything required to prove your case

    3. Detailed Legal Submissions

We prepare a comprehensive appeal skeleton argument, addressing:

    The relevant Immigration Rules

    Applicable case law

    Human rights principles

    Key errors in the decision

Why the judge should allow the appeal

    4. Advocacy & Tribunal Representation

We represent you at the hearing, ensuring your case is presented clearly, persuasively, and confidently.

    Success Through Strategic Preparation

Many appeals are won before the hearing because of strong evidence, persuasive submissions, and clear legal arguments. In some cases, the Home Office even withdraws the decision when faced with a well-prepared appeal.

Our aim is always to secure the best possible outcome as efficiently as possible.
