Partner Visa – Entry Clearance

Applying for a UK Partner Visa from outside the UK is known as entry clearance. This route allows you to join your British or settled partner in the UK and begin your pathway to settlement and citizenship.

Who Can Apply?

You may be eligible if your partner is:

A British citizen, or

Settled in the UK (with Indefinite Leave to Remain or settled status), or

In the UK with refugee or humanitarian protection, or

In the UK with limited leave under Appendix EU (pre-settled status).

After 5 years on the Spouse Visa (2.5 years + extension), you can apply for Indefinite Leave to Remain (ILR) and later British Citizenship, provided all requirements continue to be met.

    Key Requirements

To succeed, you’ll need to meet several core requirements:

    Relationship

The relationship must be genuine and subsisting.

Both must be over 18 at the time of application

    Have met in person

Be married, in a civil partnership, or in a durable relationship (Being together in a relationship akin to marriage for at least 2 years)

Intend to live together permanently in the UK

Any previous relationships must have broken down permanently.

    Financial

Combined income of at least £29,000 per year, or

Certain permitted benefits in place of income.

    Accommodation

You must show adequate accommodation in the UK without overcrowding or reliance on public funds

    English Language

At least CEFR A1 speaking and listening in English (unless exempt by nationality, degree taught in English, age, or medical condition).

    What You Get

If successful, you’ll normally receive a visa for 33 months, allowing you to live and work in the UK. After this period, you can extend your visa and continue the 5-year route to settlement.

Meeting the requirements is only the start the evidence must be prepared carefully. Many refusals are due to missing or inconsistent documents. Speak to Lexen Law today for tailored advice on your entry clearance application.

Partner Visa Entry Clearance – Quick Q&A

Q: Can I use savings instead of income?

A: Yes, if you don’t meet the £29,000 annual income threshold, you can rely on your savings. You can also combine savings with your current income to reach the £29,000 threshold. However, savings must be calculated carefully, and mistakes are a common reason for refusal. It’s essential to seek advice from an immigration adviser before applying.

Q: What level of English do I need?

A: For entry clearance, you must normally pass an approved English test at CEFR A1 level in speaking and listening, unless you are exempt. You may be exempt if, for example, you are 65 years old or over.

Q: How long will I get if granted?

A: Entry clearance is usually granted for 33 months, after which you can extend your visa.

Q: Can my partner be on benefits and still sponsor me?

A: In some cases, yes. If your partner receives certain qualifying benefits (for example Disability Living Allowance, Carer’s Allowance, or Personal Independence Payment), the strict income threshold doesn’t apply but you must still prove adequate maintenance and accommodation. This is an alternative method of meeting the financial requirement.

Q: How much are the visa fees?

A: The Home Office fee for a Partner Visa Entry Clearance is currently £1,938, plus the Immigration Health Surcharge of £1,035 per year (per adult applicant). Additional costs may apply for dependants and optional priority services.
