EU Settlement Scheme (EUSS)

The EU Settlement Scheme was introduced on the 30th March 2019 as a way to protect the rights of EU, EEA, and Swiss citizens living in the UK. It allows them and their family members to continue living, working, and studying in the UK after free movement ended on 31 December 2020.

There are two main outcomes under the scheme:

Key Points:

Settled Status (for those who lived in the UK for 5+ years).

Pre-Settled Status (for those with less than 5 years residence, leading to Settled Status later).

Unlike most UK visas, the EU Settlement Scheme is completely free no Home Office fees, no NHS surcharge, and a fully digital status.

    What is the EU Settlement Scheme?

    The EUSS gives EU citizens and their families the right to remain in the UK legally after Brexit. It ensures access to work, healthcare, education, and public services.

    Key Points:

    Protects EU, EEA & Swiss citizens’ rights in the UK.

    Grants either Settled or Pre-Settled Status.

    Status is digital proof of status is online only (no physical card).

    Covers close family members too, including those joining later.

    Who Can Apply?

    Not everyone is eligible only those linked to the EU’s free movement rights.

    Key Points:

    EU, EEA & Swiss nationals living in the UK before 31 December 2020.

    Family members of eligible citizens (spouses, partners, children).

    Late applications may be possible with reasonable grounds (e.g. illness, lack of awareness).

    Types of Status under EUSS

    There are two forms of status depending on residence history.

    Key Points:

    Settled Status: granted if you lived in the UK 5 continuous years.

    Pre-Settled Status: granted if you lived in the UK less than 5 years.

    Both statuses give access to work, NHS, and public services.

    Application Process

    Applications are made online through the UK government system.

    Apply online at GOV.UK EU Settlement Scheme.

    Biometrics (photo upload).

    No application fee (free to apply).

    Rights of EUSS Holders

    Once granted, you have rights similar to those of UK residents.

    Key Points:

    Live, work, and study in the UK.

    Access NHS healthcare, education, and certain benefits.

    Travel in and out of the UK without visa restrictions.

    Family reunification rights continue in some cases.
