Partner Visa Extension – Quick Q&A

Q: When should I apply for an extension?

A: You should apply before your current visa expires. It is advisable to apply at least 28 days before expiry.

Q: Do the financial rules change at extension stage?

A: No, the threshold is the same as for entry clearance (£29,000). However, the evidence must cover your current circumstances in the UK.

Q: What English level do I need for an extension?

A: You need to demonstrate CEFR A2 level in speaking and listening, unless you are exempt by nationality, qualifications, or health.

Q: What if I don’t meet one of the requirements?

A: If you cannot meet a requirement (for example the financial threshold), you may still qualify under exceptional circumstances where refusal would breach your human rights (Article 8 – family life). These cases are complex and require strong supporting evidence, so it’s important to seek legal advice.

Q: Can I switch into the Partner Visa route from another visa?

A: Yes, if you are in the UK on a visa, you may be able to switch to a Partner Visa from inside the UK. Some visas (for example, visit visas) do not allow switching, so it’s important to check your circumstances carefully.

Q: What happens if I don’t apply in time?

A: You risk becoming an overstayer, which can affect future applications and your eligibility for ILR under the 5 years route. Always apply before your visa runs out.

Q: How much are the visa fees?

A: The Home Office fee for a Partner Visa extension is currently £1,321, plus the Immigration Health Surcharge of £1,035 per year (per adult applicant). Additional costs may apply for dependants and optional priority services.

Q: What happens if I divorce my partner while on a Partner Visa?

A: If your relationship ends, you must notify the Home Office. The Home Office may curtail your visa (cut your visa short), typically to 60 days. In some cases, you may be able to switch to another immigration route (such as a Skilled Worker Visa, Parent route, or a visa based on domestic abuse if applicable). It is important to seek advice quickly to protect your status.
