What Is the UK Unmarried Partner Visa?

The Unmarried Partner (de facto) Visa lets non-UK nationals live in the UK with their British or Irish citizen partner or a partner who is settled on the basis of a provably genuine, committed, long-term relationship. Key Points:

Live with a British/Irish or settled partner in the UK

33-month grant, then 30-month extension

Pathway to ILR after 5 years

Work and study allowed; most public funds restricted

Couples must prove at least 2 years of living together in a genuine and subsisting relationship.

    Unmarried Partner Visa Requirements (2025)

You must meet Home Office eligibility rules covering relationship, age, status of the sponsor, financial, English, and accommodation criteria.

    Key Points:

Both partners 18+; any previous relationships ended

Sponsor is British/Irish, has ILR/settled or pre-settled status, certain Turkish routes, or humanitarian protection

Usually two years’ cohabitation (or two-year relationship with credible reasons for not living together)

Relationship is genuine and you intend to live together permanently in the UK

Adequate accommodation; no reliance on public funds

Meet English language and financial requirements

    Areas of expertise

    Financial Requirement

You must show you can support yourselves in the UK without public funds. Typically this means the UK-based partner meeting the minimum income threshold (unless exempt e.g., refugee or humanitarian protection).

    Key Points:

Meet the set minimum income threshold before the partner joins (unless exempt)

If already lawfully working in the UK, applicant income can sometimes count

Refugee/humanitarian protection sponsors are generally exempt from the threshold

Evidence must follow Home Office format and timeframes

How to Meet the Financial Requirement

Income can be from salaried/non-salaried employment, self-employment, pensions, non-employment income, or cash savings.

    Key Points:

Employment or self-employment income (with the specified month/annual evidence)

Property rental income, dividends, pensions, trust income

Cash savings held for at least 6 months can help bridge shortfalls

Maternity/paternity/adoption/sick pay can count if evidenced correctly

Combine sources where the rules allow; keep documents complete and consistent

    Proving a Genuine/Subsisting Relationship

Provide official, recent documents showing you live together—or credible proof of an ongoing, committed partnership if you do not yet cohabit.

    Key Points:

Use official documents (government, banks, utilities, landlords, medical)

Tenancy/mortgage, council tax, utilities, joint bank statements, GP/hospital letters

If not cohabiting: evidence of visits, shared childcare, financial support, regular communication

Documents should generally be less than four years old and form a coherent timeline

    English Language Requirement

Most applicants must show English at the required level or qualify under an exemption.

    Key Points:

Pass at least CEFR A1 SELT for the initial grant (unless exempt)

Alternatives: degrees taught in English (with verification) or nationality exemptions

Exemptions for those 65+ or with medical conditions preventing testing

Include valid certificate or exemption evidence in your bundle

Intention to Live Together & Accommodation

You must intend to live together permanently once in the UK and have suitable housing.

    Key Points:

Evidence of a plan to cohabit in the UK (even if not yet living together)

Accommodation must be adequate, not overcrowded, and meet health/safety standards

Provide tenancy/ownership documents, occupancy details, and (where helpful) an inspection report

How to Apply & Processing Times

Apply online via the Home Office portal, upload evidence, and attend biometrics. Typical timelines differ by where you apply.

    Key Points:

Online application + UKVCAS biometrics (in-country)

Outside UK: commonly up to ~12 weeks; inside UK: commonly ~8 weeks (can be longer in complex cases)

Priority services may be available at extra cost

Keep copies, label evidence clearly, and ensure consistency across forms and documents

    Document Checklist (Core Items)

Submit a clear, complete evidence pack that addresses every rule.

    Key Points:

Current passport/travel ID; previous passports where relevant

Sponsor’s UK status evidence (passport/BRP/eVisa share code)

Financial evidence (payslips, bank statements, tax records, business accounts, pension letters)

    English language proof or exemption

    Relationship and cohabitation evidence

Accommodation proof (and inspection report if used)

TB test (if applicable), NI number (if any), criminality disclosures, prior immigration history

    Certified translations for non-English/Welsh documents

    Fees & Processing Times (Guide)

Home Office application fees and the Immigration Health Surcharge apply; timelines vary by route and complexity.

    Key Points:

Application from outside the UK: £1,938

Application from inside the UK: £1,321

Immigration Health Surcharge: £1,035 per year (adults)

Processing: up to 24 weeks outside the UK; ~8 weeks in-country, potentially up to 12 months if requirements not met and further review needed

    Bringing Dependants

Children under 18 can usually apply as dependants and should apply at the same time as you.

    Key Points:

Apply for dependants with the main application

As of April 2024, no additional funds required specifically for dependent children under this route

Provide full birth certificates and proof of care/living arrangements

    Extensions

You can extend for 30 months before your current leave expires, meeting the same core rules.

    Key Points:

Apply before your current permission ends

Continue to meet financial, English, relationship, and accommodation requirements

Time on this route counts toward ILR at 5 years

    If Refused: Next Steps

You may have appeal rights or the option to reapply with stronger evidence.

    Key Points:

Check the refusal letter for appeal/review rights and deadlines

Address each refusal reason with targeted evidence

Consider professional representation for appeals or a rebuilt, compliant re-application

Switching to the Unmarried Partner Visa (In-Country)

Switching is possible from many visa types if you meet eligibility and apply before your current visa expires.

    Key Points:

Example: switching from Student route if in a 2-year relationship and other criteria are met

Visitors and some short-term visas generally cannot switch in-country

If ineligible to switch, leave the UK and apply from overseas

    ILR After 5 Years

Most applicants qualify for ILR after 5 continuous years on this route, subject to residence and knowledge requirements.

    Key Points:

Keep absences within limits (no more than 180 days in any rolling 12-month period)

Meet English (B1) and Life in the UK Test for ILR

ILR removes the need for further visas and the IHS; access to benefits per the rules

After 12 months of ILR, most can apply for British citizenship (subject to eligibility)
